Terms & Conditions

§ 1 Preliminary provisions

  1. Online shop Bestler is run by Paweł Jędrychowicz running a sole proprietorship under the business name: BESTLER Pawel Jedrychowicz, entered in the Central Register and Information on Business Activity (CEIDG) maintained by the minister responsible for economy, NIP: 8361761641, REGON: 141840989.          
  2. These Terms and Conditions are addressed both to Consumers and Entrepreneurs using the Shop. It defines the rules of using the Internet Shop and the rules and procedure for concluding distance sales agreements with the Customer through the Shop.  
  3. The administrator of the personal data processed in the Online Shop in relation to the implementation of the provisions of these Terms and Conditions is the Seller. Personal data shall be processed for the purposes, for the period and on the basis of the grounds and principles indicated in the privacy policy published on the website of the Internet Shop. The privacy policy contains, above all, the principles concerning the processing of personal data by the Administrator in the Internet Shop, including the grounds, purposes and duration of personal data processing and the rights of data subjects, as well as information on the use of cookies and analytical tools in the Internet Shop. The use of the Online Shop, including making purchases, is voluntary. Similarly, the related provision of personal data by the Customer or Client using the Online Shop is voluntary, subject to exceptions relating to the conclusion of a contract and the Seller's statutory obligations.        

§ 2 Information obligation

These regulations include:

  1. provisions fulfilling the information obligations under the Consumer Rights Act,
  2. provisions for registration and creation of a customer account,
  3. provisions concerning the ordering procedure,
  4. delivery and payment provisions,
  5. provisions concerning returns and complaints,
  6. provisions concerning the provision of services by electronic means.

§ 3 Definitions

  1. Consumer - a natural person concluding a contract with the Seller as part of the Shop, the subject of which is not directly related to his/her economic or professional activity.
  2. Seller - a natural person running a business under the name: BESTLER Pawel Jedrychowicz, entered in the Central Register and Information on Business Activity (CEIDG) maintained by the minister responsible for economy, NIP: 8361761641, REGON: 141840989.
  3. Customer - any entity making purchases through the Shop.   
  4. Entrepreneur - a natural person, a legal person and an organisational unit that is not a legal person but to which a separate act confers legal capacity, exercising a business on its own behalf, who uses the Shop.
  5. Shop - the online shop operated by the Seller at the Internet address https://shop.bestler.pl/
  6. Distance contract - a contract concluded with a Customer through an organised distance contracting system (within the Shop), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.
  7. Regulations - these Shop Rules. 
  8. Order - action, a declaration of will of the Customer aiming directly at the conclusion of a Sales Agreement for a Product with the Seller and the fulfilment of a performance for the benefit of the Customer, under the terms and conditions specified in these Terms and Conditions.
  9. Account - Electronic Service, a set of resources in the Service Provider's ICT system, marked with an individual name (login) and password provided by the Customer, in which data provided by the Customer and information about Orders placed by him/her in the Online Shop are stored.
  10. OPINIONS - An Electronic Service available on the Online Shop enabling the Customers to add opinions and ratings concerning the Products and the concluded Sales Contracts.
  11. ELECTRONIC SERVICE - service provided electronically by the Service Provider to the Customer via the Online Shop.
  12. INVESTIGATION - an enquiry from a Customer who is not a consumer, submitted via the Enquiry Form and expressing a wish to conclude a Sales Contract for a Product with the Seller.
  13. Consumer Rights Act - Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827 as amended).
  14. Act on the Protection of Certain Consumer Rights - Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products (Journal of Laws 2000, No. 22, item 271)
  15. Civil Code - Act of 23 April 1964 (Journal of Laws No. 16, item 93 as amended).
  16. Act on Provision of Electronic Services - Act of 18 July 2002 on provision of services by electronic means (Journal of Laws No. 144, item 1204 as amended).
  17. Cart - an element of the Shop's software in which the Products selected by the Customer for purchase are visible, and in which it is possible to determine and modify the Order data, in particular the quantity of the Products.
  18. Merchandise - a movable item available in the Store, as well as water, gas and electricity offered for sale in a specified volume or quantity.
  19. Sales Contract - Sales Contract of a Product concluded or entered into between the Customer and the Seller via the Internet Shop. The Sales Contract is also understood - according to the Product features - as a service contract and a contract for work.
  20. Proof of payment - invoice or receipt issued in accordance with the Tax Act
    on goods and services of 11 March 2004 and other relevant legislation.
  21. Payment - payment to the Seller's account via online payment methods available in the Shop or payment upon Product collection - depending on the selected payment method and the ordered Product.

  5.  The Customer may communicate with the Seller using the addresses and telephone numbers given in this paragraph.     

§ 5 Personal data in the Online Shop

  1. The administrator of the Customers' personal data collected via the Online Shop is the Seller.
  2. Customers' personal data collected by the administrator via the Online Shop are collected for the purpose of fulfilling the Sales Agreement and, if the Customer agrees, also for marketing purposes.
  3. Recipients of the personal data of the Customers of the Online Shop may be:
    • In the case of a Customer who uses postal or courier delivery methods in the Online Shop, the Administrator shall make the collected personal data of the Customer available to the selected carrier or intermediary performing the delivery on behalf of the Administrator.
    • In the case of a Customer who uses the electronic or credit card payment method in the Online Shop, the Administrator shall make the collected personal data of the Customer available to the selected entity handling the aforementioned payments in the Online Shop.
  4. The customer has the right to access and correct their data.
  5.  Provision of personal data is voluntary, although failure to provide the personal data specified in the Terms and Conditions necessary to conclude the Sales Agreement results in the impossibility to conclude the Sales Agreement.

§ 6 Technical requirements for using the Shop's IT system

In order to use the Shop, including browsing the Shop's product range and placing orders for Products, the following are necessary:

  1. a computer, laptop or other multimedia device with Internet access,
  2. access to electronic mail (e-mail),
  3. Internet browser in current version: Mozilla Firefox; Internet Explorer; Opera; Google Chrome; Safari or Microsoft Edge,
  4. Recommended minimum screen resolution: 1024×768,
  5. enable cookies and Javascript in your browser.

§ 7 General information

  1. To the fullest extent permissible by law, the Seller shall not be liable for any disruptions, including interruptions in the operation of the Shop caused by force majeure, unauthorised acts of third parties or incompatibility of the Shop with the Customer's technical infrastructure. 
  2. Browsing through the Shop's assortment does not require creating an Account. Placing orders by the Customer for Products in the Shop's assortment is possible by providing the necessary personal and address data to enable the fulfilment of the Order. 
  3.  The prices given in the Shop are given in Polish zloty and are gross prices.
  4. The final (final) amount to be paid by the Customer consists of the price for the Product, which the Customer is informed of on the pages of the Store when placing an Order, including when expressing his or her wish to be bound by a Sales Contract.
  5. In the case of a Contract covering the provision of services for an indefinite period, the final (definitive) price shall be the total price including all payments for the billing period.
  6. Where the nature of the subject matter of the Contract does not, reasonably, allow for the calculation of the final (definitive) price in advance, information on how the price will be calculated, as well as service charges and other costs, shall be provided in the Shop in the Product description.
  7. The seller cannot shift responsibility for the operation of the shop onto its customers. As a rule, the Seller is responsible for an error in the system and the display of an incorrect price, but the protection of the consumer's rights cannot take place through a gross violation of the Seller's rights. If a customer places an order and the difference between the price of the offered Goods and their actual value is very large, this calls into question the compliance of the offer with the Seller's real intentions. 

§ 8 Rules of use of the Shop 

  1. The Customer is obliged to use the Shop's service in a manner consistent with these Terms and Conditions, legal regulations, rules of social coexistence, customs accepted on the Internet (Netiquette) and good manners.
  2. In particular, the customer is obliged to:
    • refrain from actions which could hinder or disrupt the operation of the Shop's service, in particular which could hinder the use of the Shop by other Customers;
    • not to provide false personal data;
    • refrain from actions that may violate the privacy of other Clients, in particular the collection, processing and dissemination of information about other Clients without their individually expressed consent, and refrain from violating the confidentiality of correspondence;
    • not to use the Shop's website - even indirectly - for the purpose of sending unsolicited commercial information;
    • update of contact details;
    • refrain from actions detrimental to the good name of the Store and its affiliates;
    • refrain from any action that violates the privacy and reputation of others;
    • not to place on the Store's website or transmit through it any content or material which is contrary to applicable law or the principles of social co-existence, vulgar, obscene or pornographic content, content generally regarded as offensive or which infringes personal rights of others;
    • not to use another person's image, not to incite crime, not to promote violence, to refrain from morally reprehensible behaviour, and to refrain from behaviour which infringes good morals and Netiquette;
    • refrain from other behaviour that could objectively be considered as obviously undesirable, reprehensible or contrary to purpose.

§ 9 Services provided by electronic means

  1. The Seller makes it possible through the Online Shop to use free Services consisting of:
    • to browse the information on the Online Shop,
    • maintaining an Account in the Online Shop, 
    • provision of the Newsletter service, 
    • providing an interactive form for customers to contact the Seller, 
    • posting statements about the Goods in the Shop.
  1. The Services indicated in section 1 shall be provided by the Seller 24 hours a day, 7 days a week.
  1. Contract:
    • A contract for the provision of a service consisting in browsing information in the Shop is concluded for a fixed period and terminates when the Customer closes the Shop's website,
    • The agreement for the provision of the service of maintaining an Account on the Website is concluded for an indefinite period of time and is terminated as soon as the Customer submits a request for Account deletion, 
    • The Newsletter service is concluded for an indefinite period of time and is terminated as soon as the Customer requests to remove his/her email address from the Newsletter subscription service or to unsubscribe using the link in the Newsletter message, 
    • The service contract for the provision of an interactive form enabling customers to contact the Seller is concluded for a fixed period and is terminated as soon as the Seller replies, 
    • The contract for the provision of the service consisting in the posting of opinions about the Goods in the Shop is concluded for a fixed period and is terminated as soon as the opinion is added.
  1. The service of maintaining an Account in the Internet Shop is available after registration. Registration takes place by completing and accepting a registration form made available on one of the pages of the Shop.
  2. Registration is subject to your agreement to the Terms and Conditions and the provision of personal data marked as mandatory. 
  3. The Customer has the possibility to receive commercial information from the Seller in the form of messages sent to the e-mail address provided by the Customer (Newsletter service). For this purpose, the correct e-mail address should be provided or the relevant field should be activated in the registration form or the Order form. The Customer may revoke consent to sending commercial information at any time. The Newsletter is sent by the Seller only to the Customer who has subscribed.  
  4. The Customer shall have the possibility to make individual and subjective statements in the Store relating to, among other things, the Goods or the course of the transaction. By adding statements, the Customer declares that he/she owns all rights to such content, in particular copyrights, related rights and industrial property rights. 
  5. In order to post, the customer may be asked to indicate his or her details, e.g. e-mail address.
  6. Statements should be drafted in a clear and comprehensible manner and, moreover, must not contain unlawful content.
  7. Statements may not violate applicable laws, including the rights of third parties -
    In particular, they must not be defamatory, infringe personal rights or constitute an act of unfair competition.
  8. The customer posts statements on the website voluntarily. The posted statements are disseminated on the Shop's website.
  9. By posting a statement, the Customer agrees to the free use of that statement and its publication by the Seller, as well as to the development of works within the meaning of the Act on Copyright and Related Rights (Dz. U. 1994 No. 24, item 83).
  10. In the case of violation of the provisions of these Terms and Conditions by the Customer, the Seller, after an ineffective call to cease or remove the violations with setting an appropriate deadline, may terminate the contract for the provision of Services with 14 days' notice. 
  11. The Shop has the right to organise occasional competitions and promotions, the terms and conditions of which will be stated each time on the Shop's website. 

Promotions in the Store are not cumulative unless the Terms and Conditions of a particular promotion state otherwise.

§ 10 Information on price reduction of goods

  1. Whenever a reduction in the price of a good or service is communicated, the seller shall, in addition to the information on the reduced price, also display the lowest price for that good or service which was in force during the 30 days prior to the introduction of the reduction. This period shall only be reduced for goods and services which are offered for sale for less than 30 days. On the other hand, in the case of a price reduction for perishable goods or goods with a short shelf life, the price before the reduction was first applied shall be indicated next to the reduced price and the above time limits shall not apply.
  2. The obligation to inform about the price reduction applies:
    • trader who is directly party to the sales contract with the consumer,
    • communicating a price reduction,
    • reductions by a specific amount, but also percentages and slogans such as “Black Friday discount” or “prices without VAT”,
    • discounts visible on the product card, product tag, but also in advertising and promotional magazines.
  3. The obligation to inform about the price reduction does not apply:
    • planned price changes not communicated as reductions,
    • price reductions resulting from participation in loyalty programmes or personalised price reductions,
    • general advertising slogans, such as “best prices”.

§ 11 Citing sources of product reviews and recommendations

  1.  The seller provides information on published reviews and recommendations from consumers who have actually used or bought the product. It is considered an unfair practice:
    • making payments for posting or causing another person to post false or distorted consumer opinions or recommendations in order to promote products,
    • a claim by a trader that reviews/recommendations have been posted by consumers who have used or purchased the product in question, although the trader has not taken reasonable and proportionate steps to verify that the reviews are from those consumers.
  2. The addition of an opinion is possible after a total of three consecutive steps by the user:
    • go to the feedback tab on the page of the selected Product,
    • by entering the recipient's e-mail address, the content of the opinion and a graphical evaluation of the Product; and
    • by clicking on the „Add review” box. The addition of an opinion is reserved exclusively for the Customer who has made a purchase of a Product. When using the Electronic Opinions Service, the customer must provide only accurate and truthful information. The user must not provide opinions that are offensive, defamatory or factually inaccurate.
  3. The Electronic Service „Opinions” shall be provided free of charge and on a one-off basis and shall terminate as soon as an opinion or rating is added via it or as soon as the Service Recipient stops using the Electronic Service earlier. The display of an opinion or rating by a Customer on the website of the Online Shop requires prior approval of the opinion or rating by the Service Provider.

§ 12 Rules for placing an Order 

The shop sells specialist spare parts and electronic components, including soft starters (e.g. VSA LC03 p/7), speed sensors for exercise treadmills (e.g. Kettler track motion performance) and membrane keypads for industrial equipment (e.g. Variant Kornfeil ovens). The shop's range includes components that are replacements for original manufacturers' parts, characterised by increased durability and reliability.

In order to place an Order it is necessary to: 

  1. accept the Shop Rules,
  2. log into the Shop (optional);
  3. select a product from the catalogue that is the subject of the order and then add it to the shopping basket,
  4. log in or use the option of placing an order without registration;
  5. if you have chosen to place an order without registration, fill in the order form by entering the recipient's data and address to which the product is to be delivered, telephone number and e-mail address, select the type of shipment (method of Product delivery),
  6. confirm the order,
  7. select one of the available payment methods and, depending on the payment method, pay for the Order within a specified period,
  8. The Customer receives a confirmation of the Order at the e-mail address specified in the Order.

§ 13 Payment and delivery methods offered

  1. The customer can use the following payment methods:
    • Przelewy24.
  2. The Customer may use the following methods of delivery or collection of the ordered Product:
    • Paczkomaty
    • Courier deliveries
    • Personal collection at the shop.

§ 14 Performance of the sales contract

  1. The conclusion of the Contract of Sale between the Customer and the Seller takes place after the Customer has placed an Order online or using the Order Form in the Online Shop.
  2. After the Order is placed, the Seller immediately confirms its receipt and simultaneously accepts the Order for fulfilment. Confirmation of receipt of the Order and its acceptance for processing is made by the Seller sending the Customer a relevant e-mail message to the e-mail address provided by the Customer during the Order placement process, which contains at least the Seller's statements about receipt of the Order and its acceptance for processing as well as confirmation of concluding the Sales Agreement. The moment the Customer receives the above-mentioned e-mail, the Sales Agreement between the Customer and the Seller is concluded.
  3. The customer is obliged to make payment within 3 days of placing the order. Failure to make payment within the said period will result in cancellation of the order.
  4. The order will be dispatched within 3 working days after the payment is credited to the Seller's bank account. In the event of an extension of the delivery period, the Customer will be informed by the Seller.
  5. In the case of an order for Products with different readiness for collection dates, the Customer has the option to collect the Products in parts (according to their readiness for collection) or to collect all the Products once the entire order has been completed.
  6. The start of the period for the Product to be ready for collection by the Customer shall be calculated from the date on which the Seller's bank account is credited.
  7. At the latest when the consumer expresses his or her willingness to be bound by the contract, the Seller is obliged to obtain the consumer's express consent for any additional payment beyond the agreed remuneration for the Seller's main contractual obligations. If the Seller has not obtained the consumer's express consent, but has assumed its existence by using default options that the consumer must reject in order to avoid the additional payment, the consumer is entitled to a refund of the additional payment paid.
  8. Possibility to collect the goods in person at the shop.

§ 15 Right of withdrawal

  1. The Buyer, who is a consumer within the meaning of Article 22(1) of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2017, item 459), pursuant to Article 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended), has the right to withdraw from a contract concluded at a distance, without providing a reason, within 14 days from the date of receipt of the Product. 
  2. The Buyer shall not be entitled to the above entitlement in the following cases:
    (a) the provision of services, if the Seller has performed the service in full with the express consent of the Buyer, who has been informed before the performance starts that he will lose his right of withdrawal after the Seller has performed the service,
    b) contracts whose object of performance is a non-refabricated item produced to the buyer's specifications or intended to meet the buyer's individual needs,
    (c) contracts for the supply of goods which are liable to deteriorate or expire rapidly,
    d) contracts whose object of performance is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons, if the packaging has been opened by the purchaser after delivery.
  3. The right to withdraw from a contract concluded at a distance, pursuant to art. 10, sec. 3, item. 5 of the Act of 2 March 2000 on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product (Journal of Laws 2000, No. 22, item 271), the consumer is not entitled to withdraw from a distance contract in the case of services which, due to their nature, cannot be returned or whose subject matter is subject to rapid deterioration.
  4. For an effective withdrawal from the contract referred to in point 1 of this paragraph, it shall be sufficient for the Buyer to make a declaration by electronic means or by correspondence within the statutory 14-day period ascribed to it from receipt of the delivery.
  5. When withdrawing from the contract, the Buyer is obliged to return the Product together with the proof of purchase or a copy thereof within 14 days from the date of withdrawal.
  6. The Product shall be returned to the following address: BESTLER Paweł Jędrychowicz, ul. Akacjowa 25, 08-110 Siedlce.
  7. The shipping costs for the returned Product shall be borne by the Buyer.
  8. The Buyer shall be liable for any diminution in the value of the Product resulting from use beyond that which is necessary to ascertain the nature, characteristics and functioning of the Product.
  9. The Seller guarantees to refund the price of the Product and the shipping costs of the Product to the Buyer immediately, no later than within 14 days.
  10. The Seller shall refund the payment using the same method of payment used by the Buyer, unless the Buyer has expressly agreed to a different method of refund that does not incur additional costs for the Buyer.
  11. If the Buyer has chosen other than the cheapest ordinary delivery method offered by the Seller, the Seller shall not be obliged to reimburse the Buyer for the additional costs incurred by the Buyer.
  12. Returns of Products on withdrawal, sent at the Seller's expense or cash on delivery will not be accepted.
    12.If, at the consumer's request, performance of the service is to commence before the expiry of the time limit for the
    withdraw from the contract, the trader shall be obliged to obtain a statement from him
    containing such a request and an acknowledgement by the customer that, upon
    full performance of the contract, the consumer loses his right of withdrawal.
  13. The provisions of this paragraph shall not apply to Buyers who are not consumers within the meaning of Article 22(1) of the Act of 23 April 1964 - Civil Code (Journal of Laws of 2017, item 459), i.e. persons performing legal transactions directly related to their own business or professional activity - in their case the right to withdraw from the Sales Agreement is absolutely excluded.

§ 16 Claim for non-conformity of the goods with the contract

  1. The Seller undertakes to deliver the Goods in accordance with the Contract.
  2. The Seller shall be liable for non-compliance of the Goods with the agreement on the terms and conditions specified in the Act on Consumer Rights towards the Customer who is a Consumer and towards the Customer who is a natural person concluding the Agreement directly related to his/her business activity, if it follows from the content of the Agreement that it is not of a professional nature for that person, in particular resulting from the subject of his/her business activity made available on the basis of the provisions on the Central Register and Information on Business Activity. 
  3. In the case of non-conformity of the Goods with the contract, the Consumer or Entrepreneur with consumer rights may request repair or replacement of the Goods, whereby the Seller shall be entitled to repair the Goods instead of the requested replacement or vice versa, if bringing the Goods into conformity with the contract in the manner chosen by the Consumer or Entrepreneur with consumer rights would be impossible or require excessive costs or difficulties. On the other hand, if these conditions would apply to both replacement and repair, the Seller will be entitled to refuse to bring the goods into conformity with the contract. 
  4. The consumer or Entrepreneur with consumer rights can make a declaration to reduce the price or withdraw from the contract. He will have this option when: 
    • the trader will not bring the goods into conformity with the contract,
    • will refuse to do so,
    • the lack of conformity will continue despite the attempt to bring the goods into conformity with the contract,
    • the lack of conformity of the goods with the contract will be so significant as to justify the exercise of the right to reduce the price or rescind the contract without first requiring the goods to be brought into conformity with the contract or when it is clear from the circumstances or statements of the trader that he does not intend to bring the goods into conformity with the contract within a reasonable time or without excessive inconvenience for the Consumer or the Trader with rights as a consumer. The Seller shall reimburse the Consumer or Entrepreneur with consumer rights the amounts due as a result of the exercise of the right to reduce the price immediately, but no later than within 14 days of receipt of the Consumer's or Entrepreneur with consumer rights' statement on price reduction.
  5. Liability under paragraph 3 will cover non-conformity of the goods with the contract that existed at the time of delivery and became apparent within two years of that time, whereby there will be a presumption that the non-conformity disclosed within that period existed at the time of delivery.
  6. With regard to buyers who are entrepreneurs, the Seller shall be liable for defects of the sold thing, according to the principles set out in Article 556 et seq. of the Civil Code.
  7. The cost of shipping the goods under complaint shall be borne by the Seller, and the Consumer's obligation in the event of a complaint shall only be to make the goods to be repaired or replaced available to the trader.
  8. The durability guarantee may not provide for terms of repair or replacement less favourable to the consumer than those to which he is entitled under a claim for lack of conformity.
  9. Complaints resulting from violations of the Customer's rights guaranteed by law or on the basis of the present Rules and Regulations should be sent to the address of the Store: ul. Akacjowa 25, 08-110 Siedlce or electronically to the e-mail address: bestler@bestler.pl via a complaint form on the Store's website. In order to consider the complaint, the Customer should send or deliver the Goods complained about, if possible attaching the proof of purchase. The Goods should be delivered or sent to the address of the Store specified in this section above.
  10. The Seller undertakes to deal with each complaint within 14 days of its receipt. If the Seller does not respond to the complaint within the aforementioned period, he shall be deemed to have acknowledged the complaint. The response to the complaint shall be provided by the Seller to the consumer on paper or any other permanent medium.
  11. In the case of deficiencies in the complaint, the Seller shall call on the Customer to supplement the complaint to the extent necessary immediately, but no later than within 7 days, from the date of receipt of the call by the Customer. The Seller shall reimburse the Customer for postage costs.

§ 17 Complaints about the provision of electronic services

  1. The Customer may submit complaints to the Seller in relation to the functioning of the Shop and the use of the Services. Complaints can be submitted in writing to the address: ul. Akacjowa 25, 08-110 Siedlce, at the e-mail address: bestler@bestler.pl or by using the contact form.   
  2. In the complaint, the customer should state his/her name, mailing address, type and description of the problem.  
  3. The Seller undertakes to consider each complaint within 14 days of its receipt. In the case of deficiencies in the complaint, the Seller shall call on the Customer to supplement the complaint to the extent necessary within 7 days from the date of receipt of the call by the Customer.

§ 18 Out-of-court complaint and redress procedures

  1. Detailed information on the consumer's possibilities of using out-of-court complaint and redress procedures, as well as the rules of access to these procedures, are available at the offices and websites of county (municipal) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Voivodship Inspectorates of Trade Inspection and at the following internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php;  http://www.uokik.gov.pl/sprawy_indywidualne.php

  2. The consumer has the following examples of out-of-court complaint and redress procedures:
  3. The Consumer shall be entitled to apply to the permanent amicable consumer court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended) to resolve a dispute arising from the Agreement concluded with the Seller. 
  4. The Consumer shall be entitled to apply to the provincial inspector of the Commercial Inspection, pursuant to Article 36 of the Act of 15 December 2000 on the Commercial Inspection (Journal of Laws of 2014, item 148, as amended), to initiate mediation proceedings for the amicable settlement of a dispute between the Consumer and the Seller. 
  5. A consumer may obtain free assistance in resolving a dispute between him and the seller, also using free assistance from a county (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (e.g. Federation of Consumers, Association of Polish Consumers).

§ 19 Final provisions

  1. Contracts concluded through the Online Shop are concluded in the Polish language.
  2. The Seller reserves the right to make changes to these Terms and Conditions for important reasons, i.e.: changes to the law, changes to payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller shall inform the Customer about each change at least 7 days in advance.
  3. Matters not covered by these Terms and Conditions shall be governed by generally applicable provisions of Polish law, in particular: Civil Code; Act on Providing Services by Electronic Means; Act on Consumer Rights, Act on Personal Data Protection.
  4. The customer has the right to make use of out-of-court complaint and redress procedures. To this end, he can submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
